By using the Services or visiting the Site, you (“User”) acknowledge that you have read, understand, and agree to be bound by these Terms of Use (the “Terms”) and the ABA Privacy Policy.
THESE TERMS FORM A LEGALLY BINDING AGREEMENT BETWEEN YOU AND ABA. PLEASE READ CAREFULLY.
If a separate written agreement between you and ABA governs your use of certain Services, that agreement will control in the event of a conflict with these Terms.

“Site”: All websites, web pages, and mobile applications operated by ABA, including ABA profiles on social media sites, and all Content and functionality available through them.

The American Burn Association (ABA) and its affiliated entities may provide Services on behalf of one another. You acknowledge that ABA affiliates and third parties may provide Services in addition to the ABA entity with which you contract or interact.

j. Sending unsolicited invitations or marketing the Services without ABA’s approval.
4. Access to Certain Services
Some Services may require registration. You agree to provide accurate, up-to-date information and maintain confidentiality of your login credentials. You are responsible for all activities under your account and must notify ABA immediately of unauthorized use.
Users may not post confidential or HIPAA-protected information.
Certain Services may require payment; ABA will notify you before fees are applied or increased.
5. Privacy and Personal Information
The ABA Privacy Policy (incorporated by reference) explains how information is collected and used. By using the Services, you consent to that policy.
6. Changes in Services; Denial of Access
ABA may change or discontinue Services, features, or accounts at any time, with or without notice. ABA may limit transmissions, storage, or suspend accounts at its discretion.
7. Content in the Services
Content on the Site is owned by ABA, its licensors, or Users. You may not copy, distribute, or create derivative works without permission, except for Content you legally post.
ABA may review, filter, or remove Content at its discretion.
8. Disclaimers
Content is provided for informational purposes only and should not be construed as medical or legal advice. ABA does not endorse third-party content or links. Health care decisions should always be made by qualified practitioners exercising professional judgment.
9. Proprietary Rights
ABA or its licensors own all ABA trademarks, logos, and intellectual property. You may not use ABA Marks without permission.
10. Content License from the User
By posting or submitting Content, you grant ABA a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute that Content. You confirm you have the rights to grant this license.
11. Website or Software Updates
Services may include automatic updates, which you agree to receive.
12. Exclusion of Warranties; Disclaimers
Services are provided “as is” and “as available.” ABA disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. You use the Services at your own risk
13. Limitation of Liability
ABA is not liable for direct, indirect, incidental, or consequential damages, including those caused by User Content, third-party conduct, or technical issues. Your sole remedy is to stop using the Site.
14. Indemnity
You agree to indemnify and hold harmless ABA, its officers, directors, employees, and agents from claims or damages arising from your use of the Services or your Content.

16. No Data Rights
ABA is not responsible for lost or deleted Content. Users should not rely on ABA for content preservation and should maintain their own backups.

Services may display advertising. ABA does not endorse or warrant advertisers or their products.
18. Changes to these Terms
ABA may update these Terms. Continued use of the Services after changes indicates acceptance. If changes materially affect ABA’s rights, notice will be provided via email or prominent posting.
19. Dispute Resolution; Arbitration
These Terms are governed by Illinois law (except arbitration governed by the Federal Arbitration Act).
Disputes will be resolved through binding arbitration in Chicago, Illinois, on an individual basis (no class actions). Arbitration decisions are final, except as provided by law.
